Issue Statement:
Due to prior resignations and the lack of applications received to serve on this board, there are three vacant city commission appointments and one alternate position available. However, at this time, there are only two (2) submitted applications to be considered.
The vacant appointments are to be filled by Commissioner Sparks, Vice Mayor Lonergan and Mayor Adornato. Commissioner Carn and Commissioner Guevrekian's appointments will be brought forward in April when the board member's terms expire. (See board member status below.) Due to a lack of applications, only two appointments are being considered at this time.
Three members are necessary for a quorum. The Alternate position has been vacant since December 2014. Staff will continue efforts to solicit additional applications to all advisory boards.
Recommended Solution: For the City Commission to consider the two (2) submitted applications to serve on the Board of Adjustment for a term ending April 2019 and to adopt a resolution.
The Board of Adjustment was established in the Charter under Article XVII for the purpose of receiving applications and hearing appeals in cases involving zoning regulations and subject to appropriate conditions and safeguards; to make recommendations to the city commission on special exception and variance applications to the terms of zoning ordinances of the city as will not be contrary to the public interests, where owing to special conditions, a literal and exact enforcement of the provisions of zoning regulations will result in unnecessary hardship in the use of the property involved. The city commission shall make the final determination on applications for special exceptions and variances and the sole determination on appeals concerning interpretations or the application of land development regulations.
The five members and one alternate of the Board are appointed by the City Commission pursuant to Article XVI, Section 24-232 of the Oakland Park Code of Ordinances and service for a period of two years.
Code Section 24-232. Board of Adjustment states:
“Each member of the city commission shall nominate one (1) member of the board of adjustment. An alternate member shall be appointed by majority vote of the city commission. All appointments shall be subject to approval of the city commission by resolution. Vacancies in the board of adjustment shall be filled in the same manner.”
