SUBJECT: Lien Negotiated Settlement – Code Case #s  167446, 167843 & 171069 – LA Shops LLC, at 79 East Oakland Park Blvd., a commercial property.
1.BACKGROUND/HISTORY
    
 

Issue Statement: The owner of the commercial property located at 79 East Oakland Park Blvd is requesting settlement of outstanding code enforcement liens.

Recommended Solution: The City Commission approve the proposed settlement offer of $9,445 for Code Enforcement Lien - Case Numbers 167446, 167843 & 171069 – LA Shops LLC, owner of the property located at 79 East Oakland Park Blvd..

Violation of SEC.13.14 – Littering Prohibited – First Offense Citation – Fine: $100

Hearing date: 3/19/13
Required compliance date: 2/11/13
Special Magistrates ruling: Repeat violation. Fines started accruing on 2/11/13, the date of the notice of violation.
Violation of SEC.13.14 – Littering Prohibited – Complied 4/18/13 – Fine: $400/day

Required compliance date: 2/11/13
Special Magistrates ruling: Repeat violation. 

Violation of SEC.13.14 – Littering Prohibited – Fine: $1,750

 

Total fine / lien - $28,150 plus $100 citation

2.CURRENT ACTIVITY
    
 

The proposed settlement represents 30% of the outstanding $28,150 lien. The offer is $8,445, $100 for citation plus $450 administrative fee and $450 in recording & processing fees for a total amount of $9,445. The total settlement offer is to be paid within 60 days of the City Commission’s approval. Failure to pay within the 60 days would void the settlement.

The property is in compliance and there are no other outstanding issues.

This settlement is a result of the City's Lien Compliance Initiative. The property owner received a letter of notification and contacted the City to settle the outstanding lien.

3.FINANCIAL IMPACT
    
 The proposed settlement represents 30% of the outstanding $28,150 lien and will result in the City receiving $9,445 in fines and reimbursement for the City’s efforts in restoring this property into compliance with City ordinances
4.RECOMMENDATION
    
 It is recommended that the City Commission approve the proposed settlement in regard to Code Enforcement Lien - Case #s 167446, 167843 & 171069 – LA Shops LLC, at 79 East Oakland Park Blvd., a commercial property.
