SUBJECT: Moratorium on all Applications Relating to Medical Marijuana Dispensaries or Related Facilities
1.BACKGROUND/HISTORY
    
 

Legislative Update:    On February 1, 2017, the City Commission passed the ordinance on first reading establishing a moratorium until December 31, 2017.  It is recommended that the ordinance be adopted on second reading.

 

Issue Statement: On November 8, 2016, voters in the State of Florida approved Amendment 2 to the Florida Constitution, approving the sale of higher strength (THC) to treat certain limited medical conditions. The Florida Legislature and Department of Health are required to provide regulations and guidelines by June 2017.

 

Recommended Solution: The City Commission adopt on second reading an Ordinance establishing a temporary moratorium through December 31, 2017, on the submission, processing, approval or issuance of any new licenses, Business Tax Receipts, Development Orders or permits for any uses that involve the cultivation, processing, dispensing or retail sale of cannabis (marijuana).

2.CURRENT ACTIVITY
    
 

On January 4, 2017, Staff presented information to the City Commission on the subject of medical marijuana dispensaries and related operations. The City Commission was informed that staff would bring a moratorium Ordinance forward for consideration by the City Commission at a future meeting. The Ordinance would preclude the processing of any applications for dispensaries or related facilities until staff receives the state guidelines and can conduct the necessary research required to develop appropriate zoning and other permitting regulations.

 

The proposed Ordinance establishes a temporary moratorium through December 31, 2017, on the submission, processing, approval or issuance of any new licenses, Business Tax Receipts, Development Orders or permits for any uses that involve the cultivation, processing, dispensing or retail sale of cannabis (marijuana). The moratorium will allow staff sufficient time to research the appropriate land use and other types of appropriate regulation once the State releases its guidelines.
