SUBJECT: FDOT Highway Maintenance Memorandum of Agreement for Drainage Improvements at NE 13th Ave south of Commercial Blvd.
1.BACKGROUND/HISTORY
    
 

Background: The Florida Department of Transportation (FDOT) owns and maintains select rights-of-ways within the City of Oakland Park including Commercial Boulevard. The City owns and maintains most other rights-of-ways within the city limits including NE 13th Avenue. FDOT has found that NE 13 Avenue is pitched toward and conveys stormwater runoff into Commercial Boulevard creating a drainage concern at the northwest intersection. Since NE 13th Avenue and Commercial Boulevard are owned and maintained by separate entities, the stormwater systems should remain separate as well. The City  has little to no drainage system within NE 13th Avenue on the north side of Commercial Boulevard.

 

Issue StatementIn order to properly address the runoff from NE 13th Avenue into Commercial Boulevard, FDOT has drafted an agreement indicating FDOT will construct a drainage system within NE 13th Avenue to collect, store and exfiltrate the stormwater runoff within NE 13th Avenue, and the City is to own and maintain the system.

 

Recommended Action: The City Commission adopt a resolution authorizing the proper City officials to execute and submit the District Four Highway Maintenance Memorandum of Agreement (MMOA) form to the Florida Department of Transportation (FDOT).

2.CURRENT ACTIVITY
    
 FDOT is requesting the City enter into an agreement regarding a drainage concern at the intersection of NE 13th Avenue and Commercial Boulevard. The agreement states that the City will allow FDOT's contractors to construct drainage within the City's right-of-way on NE 13th Avenue, and the City shall continue to maintain the drainage system.  The proposed drainage system is specifically for runoff from NE 13th Avenue and not Commercial Boulevard.
3.FINANCIAL IMPACT
    
 The design and construction costs are to be paid by FDOT.  The financial costs for maintaining the drainage system will have a minor impact absorbed by the Public Works Stormwater Division.  
4.RECOMMENDATION
    
 It is recommended that the City Commission adopt a resolution authorizing the proper City officials to execute and submit the District Four Highway Maintenance Memorandum of Agreement (MMOA) form to the Florida Department of Transportation (FDOT).
