Legislative Statement: On January 14, 2026, the City Commission passed the ordinance on first reading by a 5-0 vote.
Issue Statement: The Florida Department of Commerce (Florida Commerce) requires the City to conduct an annual review of the Capital Improvements Element (CIE) of the City's Comprehensive Plan 2045. This update, mandated by State Statute, incorporates the Capital Improvement 5-Year Plan as adopted in the FY 2026 budget.
Recommended Action: Staff recommends the City Commission conduct a public hearing and thereafter approve on second reading the proposed Ordinance approving the FY 2026 annual update to the Capital Improvements Element of the City’s Comprehensive Plan.
Background: Section 163.3177 of the Florida Statutes mandates that local government comprehensive plans establish the policy framework for local planning and land-use decisions. These include elements addressing capital improvements, conservation, intergovernmental coordination, recreation, open space, future land use, housing, transportation, and public facilities.
To meet these statutory requirements, local governments must regularly review and update their Comprehensive Plans. The year before, the city adopted the Comprehensive Plan 2045 update, presented to the City Commission on July 17, 2024.
The annual review of the Capital Improvements Element (CIE) is part of these ongoing requirements. The CIE is structured as a "Plan Element" within the Comprehensive Plan, as specified by the State of Florida.
Florida Statutes mandate that the CIE be reviewed and updated annually to align with the City's 5-Year Capital Improvement Plan, which is adopted as part of the Fiscal Year Budget. This item amends the CIE to ensure consistency with the FY 2026 Capital Improvement Program, as approved by the City Commission.
