Issue statement: Specialized legal services related to case name: Oakland Park Dixie, LLC v. The School Board of Broward County, Broward County, and the City of Oakland Park Client Name: The City of Oakland Park Case Number: CACE-26-003633 CSK File No.: 5018.4280-00

Recommended Action:  The City Commission adopt a resolution approving the City to  engage Cole, Scott & Kissane, P.A. (the “Firm”) to serve as special counsel in connection with the above-referenced matter.  The letter and attached Statement of Engagement Terms and Billing Practices (the “Statement”) sets forth the terms and conditions of our engagement.   

Fees will be billed on a time-spent basis at the Firm’s current hourly rates, which are $325 per hour for attorneys and $150 per hour for paralegals. Because the scope and duration of the litigation cannot be determined at this time, a total estimated cost is not available. Expenses will be charged to the legal services account in the FY 2026 Adopted Budget. Staff will monitor expenses and return to the City Commission if additional budget authority is needed.
