| | | | | | | | | 1. | BACKGROUND/HISTORY | | | Issue Statement: The Americans with Disabilities Act (ADA) requires that state and local governments make all programs and services accessible to persons with disabilities. The ADA requires municipalities to review all aspects of their programs, services, and activities for compliance. This review is referred to as a Self-Evaluation and Transition Plan.
Phase 3 of the plan is intended to include the following:
1. Project Management
2. Review of City Buildings
3. Review of Parks and Trails
4. Transition Plan Update
This item seeks to continue to engage the services of Kimley-Horn and Associates, Inc. to assist the City with Phase 3 of the development of the City's ADA Self-Evaluation and Transition Plan. This Work Authorization (WA) is issued pursuant to the City’s existing Consultants' Competitive Negotiation Act (CCNA) contract (copy attached) for professional engineering and consulting services with Kimley-Horn and Associates, Inc.
Recommended Action: - The City Commission adopt a resolution authorizing the proper City Officials to execute a Work Authorization between the City and Kimley-Horn and Associates, Inc. for the ADA Self-Evaluation and Transition Plan – Phase 3, for an amount not to exceed $99,950.

| | | | | | | | | 2. | CURRENT ACTIVITY | | | Title II of the Americans with Disabilities Act (ADA) requires all public agencies to ensure that their services, programs, and activities are accessible to persons with disabilities, including facilities and public rights of way. Compliance includes conducting self-evaluation and developing an ADA Transition Plan.
A Self-Evaluation is an assessment of the public entity's services, programs, and activities and the policies and practices that govern their administration. This can include laws, ordinances, regulations, and manuals. The goal is to determine if the policies and practices adversely affect the full participation of individuals with disabilities.
The ADA Transition Plan will document the City's adherence to these administrative requirements and describe the process that will be used to complete the Self-Evaluation. The resulting Self-Evaluation will include possible solutions to remove programmatic barriers and be used to update the City's Transition Plan for the modification of facilities and public right of ways to improve accessibility, which will guide the planning and implementation of the necessary program and facility modifications over the next several years.
To continue to meet and adapt to the requirements of the ADA, the City requested a proposal from Kimley-Horn and Associates, Inc. to begin the first phase of a multi-year evaluation and development of the City's ADA Transition Plan in 2022.
Phase 1 of the ADA Self-Evaluation and Transition Plan included the development of the Transition Plan framework, documentation of the City's efforts to date, related to Title II compliance, inventory of City facilities to be evaluated in future phases, and development of a budget and schedule to complete the City's Self-Evaluation. This phase also included an ADA compliance review of City design standards, signalized intersections, public rights-of-way, sidewalks, associated curb ramps, and transit stops. An ADA Transition Plan document will continue to be developed and include formal documentation of tasks and associated findings. Phase 2 continued to evaluate public rights-of-ways.

| | | | | | | | | 3. | FINANCIAL IMPACT | | | As outlined in the attached Work Authorization with Kimley-Horn and Associates, Inc., the total cost for the ADA Self-Evaluation and Transition Plan – Phase 3 is $99,950. This initiative is identified as a Business Plan Initiative (BPI) under the City’s strategic performance area for infrastructure needs. Sufficient funds are included in the FY 2026 Adopted Budget of the Engineering & Construction Management Division for this project.
