SUBJECT: Approval of the Surtax Funding Agreement (SFA) between the City of Oakland Park and Broward County for the NE 13th Avenue Sidewalk and Drainage Improvements Project (OAKL-22-004).
1.BACKGROUND/HISTORY
    
 

Issue Statement: In November 2018, Broward County voters approved a 30-year, one percent sales surtax to fund transportation initiatives. Broward County and the cities of Broward County entered into a Transportation System Surtax Interlocal Agreement (ILA), providing a cooperative and organized process for municipalities to submit transportation projects for funding with surtax proceeds.

 

The ILA was subsequently amended, and in 2025 Broward County and participating municipalities approved the Third Amendment and Restatement of the Transportation System Surtax Interlocal Agreement. The amended ILA establishes the framework for administering municipal surtax funding and the requirements applicable to eligible municipal transportation projects.

 

The NE 13th Avenue Sidewalk and Drainage Improvements Project (OAKL-22-004) is an approved Municipal Capital Project programmed to receive Transportation Surtax funding for construction in Fiscal Year 2027. The City was originally awarded $471,137 in surtax funding for the project.

 

On October 20, 2025, the City requested authorization from Broward County to proceed with construction prior to receiving the programmed FY 2027 surtax funding and to subsequently seek reimbursement. Broward County approved the City's reimbursement request on November 26, 2025.

 

The City also requested the maximum allowable 25 percent cost escalation funding due to increased construction costs and market conditions. Broward County subsequently approved an additional $117,784.24 in cost escalation funding, increasing the maximum surtax funding available for the project from $471,137 to $588,921.24.

 

Recommended Action: Staff recommends the City Commission adopt a resolution approving the Surtax Funding Agreement between the City of Oakland Park and Broward County for the NE 13th Avenue Sidewalk and Drainage Improvements Project (OAKL-22-004), in a maximum amount of $588,921.24, and authorize the appropriate City officials to execute the Agreement and all documents necessary to implement the Agreement..

2.CURRENT ACTIVITY
    
 

Construction of the NE 13th Avenue Sidewalk and Drainage Improvements Project (OAKL-22-004) is currently underway. The project includes improvements to pedestrian and drainage infrastructure along NE 13th Avenue and sidestreets to enhance accessibility, pedestrian safety, stormwater management, and neighborhood connectivity.

 

The City requested authorization from Broward County to proceed with the construction phase in advance of receiving the Transportation Surtax funding programmed for Fiscal Year 2027. Broward County approved the City's request on November 26, 2025, allowing the City to proceed with construction and subsequently seek reimbursement for eligible project costs, subject to compliance with applicable surtax requirements.

 

The proposed Surtax Funding Agreement formalizes the funding arrangement between the City and Broward County and provides a maximum of $588,921.24 in Transportation Surtax funding for the project. This amount consists of the City's original award of $471,137 and an additional $117,784.24 in approved cost escalation funding.

 

Under the agreement, the City may request reimbursement of eligible non-surtax funds expended on the project no earlier than Fiscal Year 2027, subject to compliance with the agreement and submission of the required project and financial documentation. The approved cost escalation funding is also payable on a reimbursement basis after construction has been completed and all other project funding has been expended, as documented through final invoices and certification of completion.

 

Approval of the Surtax Funding Agreement will formalize the City's eligibility to receive the programmed Transportation Surtax funding and establish the requirements for reimbursement, reporting, and project closeout as construction progresses toward completion.

3.FINANCIAL IMPACT
    
 

There is no financial impact in FY 2026 as the Surtax funds for the NE 13th Avenue Sidewalk and Drainage Improvements Project (OAKL-22-004) is programmed for Fiscal Year 2027.  The City may seek reimbursement for eligible non-surtax funds expended on the ongoing project, subject to the terms and conditions of the Surtax Funding Agreement. 

 

The Surtax Funding Agreement provides a maximum of $588,921.24 in Broward County Transportation Surtax funding for the NE 13th Avenue Sidewalk and Drainage Improvements Project (OAKL-22-004). This amount consists of the original $471,137 award plus $117,784.24 in approved cost escalation funding.

4.RECOMMENDATION
    
 Staff recommends the City Commission adopt a resolution approving the Surtax Funding Agreement between the City of Oakland Park and Broward County for the NE 13th Avenue Sidewalk and Drainage Improvements Project (OAKL-22-004), in a maximum amount of $588,921.24, and authorize the appropriate City officials to execute the Agreement and all documents necessary to implement the Agreement.
