Issue Statement: In November 2018, Broward County voters approved a 30-year, one percent sales surtax to fund transportation initiatives. Broward County and the cities of Broward County entered into a Transportation System Surtax Interlocal Agreement (ILA), providing a cooperative and organized process for municipalities to submit transportation projects for funding with surtax proceeds.
The ILA was subsequently amended, and in 2025 Broward County and participating municipalities approved the Third Amendment and Restatement of the Transportation System Surtax Interlocal Agreement. The amended ILA establishes the framework for administering municipal surtax funding and the requirements applicable to eligible municipal transportation projects.
The NE 13th Avenue Sidewalk and Drainage Improvements Project (OAKL-22-004) is an approved Municipal Capital Project programmed to receive Transportation Surtax funding for construction in Fiscal Year 2027. The City was originally awarded $471,137 in surtax funding for the project.
On October 20, 2025, the City requested authorization from Broward County to proceed with construction prior to receiving the programmed FY 2027 surtax funding and to subsequently seek reimbursement. Broward County approved the City's reimbursement request on November 26, 2025.
The City also requested the maximum allowable 25 percent cost escalation funding due to increased construction costs and market conditions. Broward County subsequently approved an additional $117,784.24 in cost escalation funding, increasing the maximum surtax funding available for the project from $471,137 to $588,921.24.
Recommended Action: Staff recommends the City Commission adopt a resolution approving the Surtax Funding Agreement between the City of Oakland Park and Broward County for the NE 13th Avenue Sidewalk and Drainage Improvements Project (OAKL-22-004), in a maximum amount of $588,921.24, and authorize the appropriate City officials to execute the Agreement and all documents necessary to implement the Agreement..
