| | | | | | | | | SUBJECT: Request for Increase in Aggregate Expenditure Authority for Due Diligence Professional Services Related to the Potential Acquisition of Real Property from the State of Florida, Department of Commerce |

| | | | | | | | | 1. | BACKGROUND/HISTORY | | | Issue Statement: On August 5, 2026, the City Commission adopted a Resolution of Support authorizing the City Manager to negotiate the potential acquisition of nine (9) parcels totaling approximately five (5) acres along West Oakland Park Boulevard from the State of Florida, Department of Commerce (“Commerce”).
The City Commission also authorized the City Manager to procure and execute agreements for professional services necessary to conduct due diligence associated with the potential acquisition, including individual procurements that may exceed the $25,000 purchasing threshold. These services include environmental assessments, surveys, title review, and other professional services necessary to evaluate the Property before a definitive Purchase and Sale Agreement is presented to the City Commission. During consideration of the item, the City Commission established a maximum aggregate expenditure authority of $75,000 for due diligence activities.
As due diligence has progressed, $65,100 of the existing $75,000 authorization has been committed. Additional environmental investigation has now been recommended, and other due diligence expenditures may be identified as the evaluation of the Property continues. Staff is therefore requesting an increase in the aggregate expenditure authority from $75,000 to $100,000.
Recommended Action:
Staff recommends the City Commission adopt a Resolution increasing the aggregate expenditure authority for professional services related to due diligence for the potential acquisition of the State of Florida, Department of Commerce Property from $75,000 to an amount not to exceed $100,000.

| | | | | | | | | 2. | CURRENT ACTIVITY | | | Following the August 5, 2026 authorization, staff initiated due diligence on the Property. To date, the following professional services have been procured:

During the environmental review, Langan Engineering & Environmental identified conditions associated with adjoining properties that warranted further evaluation. Based on its review, Langan recommended a limited Phase II Environmental Site Assessment to evaluate whether environmental conditions from adjoining properties may have affected the subject Property. The estimated cost of the limited Phase II investigation is $12,000.
The Phase II investigation alone would exceed the remaining authorization by $2,100. In addition, further expenditures may be necessary as environmental, survey, title, legal, and other due diligence activities continue.
Increasing the aggregate authorization to $100,000 would provide an additional $25,000 in expenditure authority. After the currently anticipated $12,000 Phase II investigation, approximately $22,900 would remain available for additional due diligence that may be necessary to complete the City's evaluation of the Property.

To date, the City has committed $65,100, consisting of $5,500 for the Phase I Environmental Site Assessment and $59,600 for the survey. This leaves $9,900 available under the existing authorization.

The proposed limited Phase II Environmental Site Testing is $12,000. As a result, an additional $2,100 in expenditure authority is required to fully fund the Phase II work.
Staff is requesting an increase of $25,000 in the aggregate due diligence expenditure authority, or a total of $100,000. After funding the Phase II work, approximately $22,900 in additional authority would remain available for other due diligence that may be identified as the environmental, survey, title, and property review continues. As identified in the August 5, 2026 agenda report, due diligence costs associated with the proposed acquisition may include environmental assessments, surveys, title, legal, and other related professional services.
These expenditures do not obligate the City to acquire the Property. Any acquisition remains subject to separate City Commission consideration and approval of a definitive Purchase and Sale Agreement and other required acquisition actions.
Sufficient funds are available within the professional services account of the Engineering and Community Development. |
