SUBJECT: A public hearing to consider amending Chapter 24, Article 3 of the City’s Land Development Code, to modify section 24-41, Master Business List to add “add distance separation requirements for the “Massage and Health Spa, State Licensed” Business Listing type.  
1.BACKGROUND/HISTORY
    
 

Issue Statement:  There is no existing distance separation requirement for state licensed massage and health spa facilities.

 

Recommended Action:  The Planning and Zoning Board recommended approval of the attached Ordinance amending Section 24-41 to establish a distance separation requirement for these state licensed massage and health spa facilities.

2.CURRENT ACTIVITY
    
 

The Zoning Ordinance permits state licensed massage and health spa facilities in most commercial zones, and it differentiates state licensed facilities from massage establishment in general, which are not permitted.  An additional ordinance is proposed to City Commission to regulate local permitting process for state licensed massage and health spa facilities.  In order to avoid the over-concentration of these types of facilities in one area, a distance separation of 1,500 feet is proposed through this ordinance.    

 

Proposed is a modification to Section 24-41, the Master Business List, adding Supplemental Regulation number 15 to this use type.  It states that a distance separation of 1,500 feet is required for each state licensed massage and health spa facility.

Staff recommends that the Planning & Zoning Board recommend to the City Commission approval of the Text Amendment Ordinance.
