Due to the proposed redevelopment, replatting is required. The replatting and rezoning of the subject property require Planning and Zoning Board and City Commission approvals.
Proposed Project: The applicant proposes to build up to 405 dwelling units consisting of the following:
· 273 single-family houses
· 132 townhouses
· Internal Infrastructure
· New private roadway network
· Community Center
Findings and Applicable Codes
The plat requires review and approval by Broward County and requires recordation, and it is to be subject to its Development Review Report. A plat note will need to be added limiting the property to 405 dwelling units, applicable infrastructure, and recreation facilities.
The submitted plat is a boundary plat. Future lots created in this property shall be in accordance with the site plan approved through the creation of the Oak Tree Planned Unit Development (PUD). A lot plan shall be provided and approved by the City prior to submittal to the Broward County Property Appraiser.
Non-Vehicular Access Lines depict access points. The plat provides five access points:
· 38.2’ opening along Prospect Road for Oak Tree Drive providing access to Oak Tree Estates;
· 100’ opening along Prospect Road for the main entrance to the proposed development;
· 100’ opening along NW 44th Street for a resident entrance to the proposed development;
· 20’ opening along NW 21st Avenue for an emergency accessway; and
· 20’ opening along NW 44th Street for an emergency accessway.
· Right of way is being dedicated for NW 44th Street, NW 21st Avenue, and for Prospect Road.
The proposed plat depicts an existing ingress-egress easement previously dedicated by separate instrument providing access to the Oak Tree Estates neighborhood (Golf-Tam Village Plat).
The plat shall include a note restricting the site to 405 dwelling units.
Section 24-188
(B) Definitions.
Plat: A map or delineated representation of the subdivision of lands, being a complete exact representation of the subdivision and other information in compliance with the requirement of all applicable sections of this chapter…
Plat, Final: A complete and exact subdivision plan, prepared for official recording as required by statute and ordinance, to identify and define property rights, dedications, and public improvements.
(C) Platting required. An approved plat shall be filed and recorded in the public records of Broward County, Florida, in the following instances:
(1) Any subdivision of land; or
(2) Any resubdivision of land; or
(3) Prior to the issuance of a building permit for construction of a principal building upon unplatted land.
Section 24-189
(D) General review procedures / Approval of final plat.
(3) When reviewed by the planning and zoning board: The board shall review the final plat at a scheduled public meeting.
(4) Presentation to the city commission: Within sixty (60) days after approval of a final plat by the planning and zoning board, the final plat or section thereof shall be presented for approval by the city commission. Should the plat not be presented to the city commission within sixty (60) days, the approval of the planning and zoning board shall expire unless a written request for an extension is submitted to the community development department and granted.
Sec. 24-191. - Requirements for final plats.
Final plats shall include all information required by Broward County for such plats.
