SUBJECT: Review of Brownfield Site Rehabilitation Agreement (BSRA)
1.BACKGROUND/HISTORY
    
 

Issue Statement: On February 7, 2018, the City Commission of the City of Oakland Park designated the 2.07-acre City owned property located on North Dixie Highway between N.E. 37th Street and N.E. 39th Street (formerly referred to as the “Dixie Lots”) as a Green Reuse Area (Brownfield Area).  Under the applicable provisions of the governing statute, the City is required to present a site assessment report, remediation plan, and Brownfield Site Rehabilitation Agreement to an Advisory Committee.   The person responsible for brownfield site rehabilitation, which would be the City of Oakland Park, must hold a meeting or attend a regularly scheduled meeting to inform the advisory committee of the findings and recommendations in the site assessment report or the technical document containing the proposed course of action following site assessment.  

 

Background:  The purpose of designating a site as a Brownfield is to promote environmental restoration, economic redevelopment, and more sustainable growth.  Now that the designation is in place, the City is able to enter into a Brownfield Site Rehabilitation Agreement (BSRA) with Broward County and access financial and regulatory incentives, including but not limited to Voluntary Cleanup Tax Credits which will allow the City to recapture at least 67.5% of all costs spent on addressing contamination in connection with the project.    

 

The City has been working with Langan Engineering, in partnership with Integra, the project developer, who has completed the initial environmental testing and established a proposed site remediation plan. 

2.CURRENT ACTIVITY
    
 Current Situation: The initial environmental review is complete.   A plan for remediation has been approved by the City and Integra and submitted to Broward County.  That plan is pending review and approval by Broward County.  Once Broward County has signed off on the plan, staff will present a contract for cleanup to the Commission for consideration.  

 

The next step in the process is to:

Submit the Plan and Brownfield Site Rehabilitation Agreement (BSRA) to Broward County for approval; and 

Establish an Advisory Committee or use an existing committee that has experience in redevelopment pursuant to Florida State Statute. 

 

Due to the extensive experience with development and redevelopment, the City is seeking for the Local Planning Agency (LPA) to act as the Advisory Committee.    The next steps in the process are as follows:

 

The LPA will formally express its intent to address redevelopment of the specific brownfield area for the purpose of improving public participation and receiving public comments; and

City will provide a copy of the final proposed draft BSRA and a copy of the executed BSRA (once received); and

City will report to the LPA of the findings and recommendations in the site assessment report or the technical document containing the proposed course of action following site assessment.

The Local Planning Agency act as the Advisory Committee  and  review the attached Brownfield Site Rehabilitation Agreement (BSRA).
