SUBJECT: Execution of Supplemental Local Agency Program (LAP) Agreement to provide funding for the construction of the NW 10th Avenue Project from Park Lane (NW 38th Street) to Prospect Road.
1.BACKGROUND/HISTORY
    
 

Issue Statement: The NW 10th Avenue project is partially funded by a Transportation Alternative Program (TAP) grant.  In November 2018, the City entered into the Local Agency Program (LAP) Agreement.  An amendment to the LAP is necessary to revise the eligible grant funded items to reflect the awarded construction elements, as well as, federally mandated items for reimbursement.   

 

Recommended Action: Staff recommends that the City Commission adopt a resolution authorizing the appropriate City Officials to execute the Supplemental Local Agency Program Agreement FPN: 438285-1-58-01 with the Florida Department of Transportation for the construction of the NW 10th Avenue Project and to approve the proposed amendment to the FY 2019 budget..

 

Background:  The NW 10th Avenue construction project was approved as part of the Fiscal Year 2019 Budget and included in the Capital Improvement Plan (CIP). NW 10th Avenue is one of only two roads providing access to the Royal Palm Isles neighborhood. This project will help improve this vital connection between Prospect Road and Park Lane West.

 

Current design includes transportation and beautification improvements, including shared sidewalk/bike lanes (southbound, west side of NW 10th), northbound dedicated green bicycle lane, additional lighting, and landscaping.


2.CURRENT ACTIVITY
    
 

The City received the attached Supplemental Local Agency Program Agreement FPN: 438285-1-58-01 for execution.

 

The supplemental agreement is being requested by FDOT and will reduce the grant contribution from $1,080,715 to $669,000.  This reduction is predicated upon FDOT’s review of the original bid and new guidance that certain project elements have been determined to be ineligible for grant funding, such as material testing, milling of the existing asphalt pavement, installation of curb and gutter, and other elements. 

 

Staff has worked diligently to maintain the project’s scope while minimizing the financial impact of the grant reduction.  Through a use of project contingency funds, savings on other projects, coordination with FPL and FDOT, and negotiations with the construction contractor resulting in savings of approximately $175,935, the City is able to implement the project as envisioned with only a minimal additional financial outlay ($42,136)

 


3.FINANCIAL IMPACT
    
 

Due to the reduction in the grant, as mentioned above, the resulting City contribution has increased by a net of $42,136. The total project costs are not changing, but the distribution of funding sources needs to be revised to reflect the TAP grant reduction and the need for additional City funds for the project.

 

This additional funding requirement  is offset by available savings in other projects and use of the project's contingency budget.. Attached in Exhibit A is the proposed budget amendment to the FY19 CIP Budget of NW 10th Project to use available CIP fund balance of $40,544 ($42,136 less $1,592) to provide additional funding for the City's required contribution to such project. 

 

The award of the NW 10th project occurred in FY 2019.  Under State law, amendments to the immediate prior fiscal year can be made up to 60 after the beginning of the new fiscal year.  The proposed amendment does not immediately affect the FY 20 budget; the project budget not expended in FY 19 will be "rolled" into the FY 20 as part of the rollover amendment to be considered by the Commission later this fiscal year.

 
       

 

4.RECOMMENDATION
    
 

Staff recommends that the City Commission adopt a resolution authorizing the appropriate City Officials to execute the Supplemental Local Agency Program Agreement FPN: 438285-1-58-01 with the Florida Department of Transportation for the construction of the NW 10th Avenue Project, and approve the proposed Budget Amendment to the FY 2019 budget.
