SUBJECT: Lien Negotiated Settlement – Code Case Number 186966 – with Genpath, Ltd, for the property at 4001-4011 N Federal Hwy, a commercial property.
1.BACKGROUND/HISTORY
    
 

Issue Statement: The owner of the property located at 4001-4011 N Federal Hwy, is requesting settlement of outstanding code enforcement lien and fine of $33,250.

Recommended Action: The City Commission approve the proposed settlement offer of $10,350 for Code Enforcement Lien - Case Number 186966 – Genpath, Ltd, owner of the property at 4001 - 4011 N Federal Hwy, a commercial property.

Required compliance date:  12/1/18

Violation of Sec.4.10(B) Animals – Retail Sale of Dogs and Cats – Complied 8/26/2019

 

All fines accrue at $125/day

 

Total fine / lien - $33,250

 

2.CURRENT ACTIVITY
    
 

The offer is $9,975 plus $375 fees for a total of $10,350. The settlement offer represents 30% of the outstanding lien balance plus fees and is to be paid within sixty (60) days of the City Commission’s approval. Failure to pay within the sixty (60) days would void the settlement.

 

The property is currently in compliance and there are no other outstanding code cases against the property.


3.FINANCIAL IMPACT
    
 The proposed settlement will result in the City receiving $10,350 in fines and reimbursement for the City’s efforts in restoring this property into compliance with City ordinances
4.RECOMMENDATION
    
 It is recommended that the City Commission approve the proposed settlement in regard to Code Enforcement Lien - Case Numbers 167865, 167866, 183099, & 186966   – Genpath, Ltd, for the property at 4001 - 4011 N Federal Hwy, a mixed use property
