1.BACKGROUND/HISTORY
    
 

Issue Statement: The owner of the property located at 4051 NE 16 Avenue is requesting settlement of an outstanding Code Enforcement lien and fines of $58,375.

 

Recommended Solution: The City Commission consider approval of the proposed settlement offer of $8,825 for Code Enforcement Lien - Code Case # 177334 – with Vigliotti Enterprises Corp Inc, owner of the property at 4051 NE 16 Avenue.

2.CURRENT ACTIVITY
    
 

The settlement offer is $8,500 plus $325.00 in hard costs for a total of $8,825. The total settlement offer is to be paid within sixty (60) days of the City Commission’s approval. Failure to pay within the sixty (60) days will void the settlement.

 

The City of Oakland Park's Lien Settlement Policy, as amended and approved by the City Commission on September 1, 2010, allows the City to negotiate a settlement for liens in excess of $25,000 with the concurrence of the City Attorney, and brought before the City Commission for approval.

 

This residential property accrued $58,375 in fines, and the property owner negotiated a settlement of $8,500, which amounts to 14.5% of the accrued fines. The negotiated settlement meets the requirements of the City's Lien Settlement Policy.


3.FINANCIAL IMPACT
    
 

The breakdown of the fees to be collected are as follows:

 

Total Fines/Lien:                              $58,375

 

Settlement Offer:                               $8,500   (14.5% of total lien amount)

(less) Orange Lien fees:                    $1,700   (20% of settlement)

(plus) Hard costs:                                $325
