SUBJECT: Code Lien Settlement 1598 NE 36 Street, Case #189966 
1.BACKGROUND/HISTORY
    
 

Issue Statement: The owner of the residential property located at 1598 NE 36 ST, is requesting settlement of outstanding code enforcement lien and fine of $83,100.00.

 

Recommended Solution: The City Commission approve the proposed settlement offer of $2,500 for Code Enforcement Lien Code Case #189966 – with Alexander Gardiner the owner of the residential property at 1598 NE 36 ST.

2.CURRENT ACTIVITY
    
 

The property owner, Mr. Alexander Gardiner, was stationed overseas serving in the United States Army during the time the violations existed on the property. Mr. Gardiner had a relative residing in the home who did not properly maintain the property.  Mr. Gardiner was unaware of the violations and corrected them as soon as he received notice and returned home.  Mr. Gardiner has provided the Community Enhancement Division with the appropriate military documentation substantiating that he was on active duty service during the period of non-compliance.

 

The offer is $2,500 which includes all administrative, recording and processing fees. The total settlement offer is to be paid within ninety (90) days of the City Commission’s approval. Failure to pay within the ninety (90) days would void the settlement.

3.FINANCIAL IMPACT
    
 
The proposed settlement will result in the City receiving $2,500 in fines, less the 20% Orange Lien Data LLC would receive based on their contract with the City for lien negotiations.
4.RECOMMENDATION
    
 It is recommended that the City Commission approve the proposed settlement in regard to Code Enforcement Lien - Code Case #189966 – with Alexander Gardiner, owner of the residential property at 1598 NE 36 ST.
