Platting is required for this site to be developed with a principal building. The proposed plat would cover the easternmost portion of the property extending 155 feet from NE 6th Avenue. A 9’ portion of the property along NE 6th Avenue would be dedicated to the County for additional right of way as well as two chords at the northeast and southeast corner of the plat area. This would result in a 40,240 square foot parcel, to be designated as Parcel A, for construction of the new fire station and and a restroom building for the park. The site plan for the fire station and new restroom building is undergoing review for approval by the Development Review Committee.
The County requires the dedication of land along NE 6th Avenue in order to ensure adequate right-of-way is available in the future and to create corner triangles to facilitate vehicle movements. The County also requires there to be a plat note restricting the platted site to a 22,000 square foot fire station. Additionally, the plat would not permit vehicle access or driveways into the site directly from NE 6th Avenue, as there would be a non-vehicle access line along the western boundary.
Findings and Applicable Codes
The City requires platting of the portion of the site where the fire station is to be constructed. The plat requires review and approval from Broward County and is to be subject to its Development Review Report, which is forthcoming. The Development Review Committee is reviewing the site plan and ensuring the City adheres to specific site configuration details required by the Land Development Code.
· Neighborhood Participation requirements have been satisfied for this application.
· The Development Review Committee reviewed the plat in accordance with Section 24-164 as well as a site plan associated with the property.
· The City Commission has final municipal approval authority of the Plat application.
Section 24-188
(B) Definitions.
Plat: A map or delineated representation of the subdivision of lands, being a complete exact representation of the subdivision and other information in compliance with the requirement of all applicable sections of this chapter…
Plat, Final: A complete and exact subdivision plan, prepared for official recording as required by statute and ordinance, to identify and define property rights, dedications, and public improvements.
(C) Platting required. An approved plat shall be filed and recorded in the public records of Broward County, Florida, in the following instances:
(1) Any subdivision of land; or
(2) Any resubdivision of land; or
(3) Prior to the issuance of a building permit for construction of a principal building upon unplatted land.
Section 24-189
(D) General review procedures / Approval of final plat.
(3) When reviewed by the planning and zoning board: The board shall review the final plat at a scheduled public meeting.
(4) Presentation to the city commission: Within sixty (60) days after approval of a final plat by the planning and zoning board, the final plat or section thereof shall be presented for approval by the city commission. Should the plat not be presented to the city commission within sixty (60) days, the approval of the planning and zoning board shall expire unless a written request for an extension is submitted to the community development department and granted.
Sec. 24-191. - Requirements for final plats.
Final plats shall include all information required by Broward County for such plats.
