SUBJECT: Approval of the project specific Interlocal Agreement (ILA) between the City and Broward County for the surtax-funded Oakland Park Boulevard Phase II Landscaping Project from NW 21st Avenue to NW 31st Avenue (OAKL-099).
1.BACKGROUND/HISTORY
    
 

Issue Statement: In November 2018, Broward County voters approved a 30-year, one percent sales surtax to fund transportation initiatives. 

 

Broward County and the cities of Broward County entered into a Transportation System Surtax Interlocal Agreement (ILA) providing for a cooperative and organized process for the municipalities to submit projects for funding with Transportation Surtax proceeds. In September 2019, the ILA was amended to provide for evaluation and ranking of municipal capital projects, and the County's evaluation and ranking of municipal maintenance projects. In January 2021 the ILA was amended for the second time to outline ranking and criteria requirements; document the agreed upon process for funding municipal capital projects; and document allocation of FY2019, FY2020, and FY2021 proceeds for municipal capital projects amongst other things.

 

For individual projects approved for funding, municipalities are required to enter into project specific Interlocal Agreements in order to seek reimbursement for project related expenses. With funding approved for the Oakland Park Boulevard Phase II Landscaping Project, a project specific ILA is required before the project can proceed to construction.

 

Recommended Action: Staff recommends that the City Commission adopt a resolution authorizing the execution of the project specific Interlocal Agreement (ILA) between the City and Broward County for the Oakland Park Blvd. Phase II Landscaping Project from NW 21st Avenue to NW 31st Avenue (OAKL-099).

2.CURRENT ACTIVITY
    
 

The Oakland Park Boulevard (OPB) Phase II Landscaping Project (NW 21st Avenue to NW 31st Avenue) is a continuation of the previously completed OPB Phase I Project (I-95 to NW 21st Avenue). With OPB being a State Road, any improvements contemplated or performed on the road requires Florida Department of Transportation (FDOT) approval. OPB Phase II Landscaping design was completed in 2019 with plans approved by FDOT in 2020 which permits the City to move forward with planned improvements.

 

With the OPB Phase II Project completely designed and having FDOT authorization to proceed with work within their right-of-way, staff provided all required information to Broward County to start the project review process as required for surtax funding reimbursement. Broward County has approved the submitted documentation and only requires the submission of the project specific ILA in order to finalize the process.

 

Upon execution of the ILA City staff will proceed with the contractor procurement process.

3.FINANCIAL IMPACT
    
 

As shown in the attached Interlocal Agreement (ILA) between the City and Broward County for the surtax-funded Oakland Park Boulevard Phase II Landscaping Project, the maximum amount payable by the County is $330,006. Of this, $293,006 is for construction and $37,000 for CEI. This amount is included in the FY 2021 Capital Improvement Plan Budget.  The total project budget is $442,000.  Other funding includes a $105,300 Florida Highway Beautification Grant.  The remaining $6,694 budget is funded by a transfer from the General Fund. 


4.RECOMMENDATION
    
 

That City Commission adopt a resolution to approve and authorize the execution of the project specific Interlocal Agreement (ILA) between the City and Broward County for the Oakland Park Blvd. Phase II Landscaping Project from NW 21st Avenue to NW 31st Avenue (OAKL-099).
