| | | | | | | | SUBJECT: Approval of the Fourth Amendment to City Attorney Employment Agreement |

| | | | | | | | 1. | BACKGROUND/HISTORY | |
The initial agreement with the City and the law firm of Josias, Goren, Cherof, Doody & Ezrol, P.A. n/k/a Goren, Cherof, Doody & Ezrol, P.A. was entered into in April of 2001. An Amendment to the Employment Contract was approved in September of 2005. In January 2008, a budget amendment was approved by the City Commission which served to increase the monthly retainer and hourly rate to the current rate. A Second Amendment to the Employment Agreement was approved in 2010 to provide consistency with the previously approved budget amendment. The Second Amendment did not increase the annual retainer nor was there any increase in the hourly rate. A Third Amendment to the Employment Agreement was approved in 2014 providing an adjustment to the hourly rate.

| | | | | | | | 2. | CURRENT ACTIVITY | | The Fourth Amendment will serve to amend the Employment Agreement to provide for an adjustment to the hourly rate increasing it from $215.00 per hour to $250.00 per hour.

| | | | | | | | 3. | FINANCIAL IMPACT | | The increase in the hourly rate will result in matters that are billed to the City, such as real estate matters, litigation, labor, attendance at Board meetings, etc. will be billed at $250.00 per hour.
The cost of this increase will be absorbed into the FY 22 Recommended Budget. |

| | | | | | | | 4. | RECOMMENDATION | | It is respectfully requested the City Commission approve the Resolution and authorize the proper city officials to execute the Fourth Amendment to the Employment Agreement between the City and the law firm of Goren, Cherof, Doody & Ezrol, P.A. |
