Issue Statement: In an effort to increase efficiency and create a more user friendly approach, over the past year the City has been reviewing City fees and incorporating City fees into a Fee Schedule/Book. Staff is proposing to update Community and Economic Development Fees and is seeking to remove the current fees from City Ordinance and incorporate these into a comprehensive user friendly Fee Booklet of City Fees adopted via resolution. It is noted, however, that certain fees such as impact fees are required to be adopted by Ordinance, and as such will remain in the Land Development Code with reference in the Fee Booklet.
Recommended Action: Staff recommends that the City Commission approve the attached Ordinance amending Article IV - Planned Development Districts, Sections 24-50 & 24-56 and Article XI – Signs, Section 24-153 of the Land Development Code to incorporate the fees into a Fee Booklet to be adopted by Resolution.
The proposed fees will be presented along with Second Reading of the Ordinance.
Background: The Department of Community and Economic Development fees are located in various sections of the City's Code of Ordinance including Chapters 7, 8, 21, and 24. Each Chapter is required to be heard as a separate agenda item. This item proposes the amendment of Chapter 24.
Planning and Zoning Board Summary: At the Planning and Zoning Board’s meeting of July 12, 2021, the proposed text amendment was considered at a public hearing. Staff made a presentation to the Planning and Zoning Board, describing the proposed amendments to the City’s Code of Ordinances. No member of the public spoke or provided written comments. The Board discussed the item, with Board Member Van de Bogart noting that he felt the Planning and Zoning Board should review proposed fee changes.
Board Member Van de Bogart made a motion to recommend approval of the text amendment with the added recommendation that the Planning and Zoning Board be presented proposed fee amendments prior to the City Commission for fees currently in Chapter 24.The motion was seconded by Board Member Fischer. The Planning and Zoning Board took an action by a unanimous vote of 5-0, to recommend approval.
Subsequent to the Planning and Zoning Board public hearing, the City Attorney opined that review and/or setting of fees is not within the purview of the Planning and Zoning Board.
