 An application by the Broward County Housing Authority for Plat Approval to create a total of nine lots at two sites, 1860 NW 27 Street and at the southeast corner of NW 27 Street and NW 20 Avenue, Oakland Park, Florida 33311.- Case #CD20-10PZ “-“BCHA Oakland Park" Plat

1.BACKGROUND/HISTORY
    
 

Issue Statement: The Broward County Housing Authority requests Plat Approval to create a total of nine single-family lots at two sites, 1860 NW 27 Street and at the southeast corner of NW 27 Street and NW 20 Avenue.

 

Recommended Action: The City Commission hold a public hearing and consider adoption of a resolution to approve the "BCHA Oakland Park" Plat. If approved, the Plat Note should restrict the Plat to nine (9) single-family dwelling units.

 

 

Neighborhood Participation Meeting: The Neighborhood Participation Meeting was held on March 23, 2020. In accordance with Section 24-163(E)(5) of the Oakland Park Code of Ordinances, an additional Neighborhood Participation Meeting was held October 7, 2021. 

 

Planning and Zoning Board:  At the Planning and Zoning Board’s meeting of September 20, 2021, the proposed plat application for the property at 1860 NW 27 Street and at the southeast corner of NW 27 Street and NW 20 Avenue, Oakland Park, FL 33311 was considered at a public hearing. Staff made a presentation to the Planning and Zoning Board, describing the project in relation to the City’s Code of Ordinances.

 

The following members of the public provided comments regarding the application:

  • Shalanda Giles Nelson attended the public hearing via Zoom and inquired if the proposed value of the homes had been determined or if it would be based on the current market value.
  • Joshua Josue submitted written comments which were read into the record at the public hearing, stating he would oppose the project if the homes were to be duplex or triplex or not single-family homes.
  • Leticia Newbold spoke on beautifying the entryways to the neighborhood.

 

The Board discussed the item after hearing the comments. Board Member Peterson asked if this would be a plat for affordable housing. The applicant responded that the project would be intended as single-family, for sale, workforce housing, later explaining that workforce housing serves households with incomes ranging between 80 and 120 percent of area median income. Board Member Fischer asked about the Neighborhood Participation Meetings and was provided information about the these meetings. He also asked about the platting and site plan review process, and he got confirmation that the zoning for this site is single-family. Board Chair Rivelli asked about the organizational structure of the applicant, which was explained.

 

The Planning and Zoning Board took an action by a vote of 4-0 to recommend approval of the Plat application to the City Commission.

 

 

Background:  This subject site consists of two corner properties in the Lakeside neighborhood. At the southeast corner of NW 27 Street and NW 19 Avenue is a 45,837 square foot rectangular property (19 Avenue site) with 148 feet of NW 27 Street frontage and 310 feet of NW 19 Avenue frontage. At the southeast corner of NW 27 Street and NW 20 Avenue is a 26,937 square foot irregular property (20 Avenue site) with 68 feet of NW 27 Street frontage and 220 feet of NW 20 Avenue frontage. Both sites are vacant. The NW 19 Avenue site is currently platted as Lot 5 and part of Lot 7 in Block 2 of the Gedeon Subdivision.  The NW 20 Avenue site is currently platted as lots 1 and 5 in the Piepho Subdivision.   

 

 

 

2.CURRENT ACTIVITY
    
 

Platting: The applicant proposes to subdivide both properties, creating six (6) lots at the NW 19 Avenue site and three (3) lots at the NW 20 Avenue site.

 

Proposed Project: The Applicant proposes to develop nine one-story single-family dwellings that would be designed in accordance with zoning regulations. Parking for each dwelling would be provided through a front-facing two-car garage with a two-car wide driveway. 

 

Findings:  The lots to be created through this subdivision would meet or exceed the minimum requirements of the Land Development Code. In the R-1, Single Family Residential zone, the minimum lot width is 60 feet, and the minimum lot area is 6,000 square feet. Proposed lot widths would range from 90 to 97 feet, and proposed lot area sizes would range from 6,000 to 13,486 square feet. All lots would front on existing rights of way. This subdivision would create lots for affordable single-family, detached residential dwellings, as permitted in this zoning district and by the Comprehensive Plan.

 

The Development Review Committee (DRC) reviewed the site plan to ensure the development adheres to specific site configuration details required by the Land Development Code. The Development Review Committee also reviewed the plat in accordance with Section 24-164. The City Commission has final municipal approval authority of the Plat application.

Section 24-188

(B) Definitions.

Plat: A map or delineated representation of the subdivision of lands, being a complete exact representation of the subdivision and other information in compliance with the requirement of all applicable sections of this chapter…

Plat, Final: A complete and exact subdivision plan, prepared for official recording as required by statute and ordinance, to identify and define property rights, dedications, and public improvements.

(C)  Platting required.  An approved plat shall be filed and recorded in the public records of Broward County, Florida, in the following instances:

(1) Any subdivision of land; or

(2) Any resubdivision of land; or

(3) Prior to the issuance of a building permit for construction of a principal building upon unplatted land.

 

Section 24-189

(D)  General review procedures / Approval of final plat.

(3) When reviewed by the planning and zoning board: The board shall review the final plat at a scheduled public meeting.

(4) Presentation to the city commission: Within sixty (60) days after approval of a final plat by the planning and zoning board, the final plat or section thereof shall be presented for approval by the city commission. Should the plat not be presented to the city commission within sixty (60) days, the approval of the planning and zoning board shall expire unless a written request for an extension is submitted to the community development department and granted.

 

Sec. 24-191. - Requirements for final plats.

Final plats shall include all information required by Broward County for such plats.
