SUBJECT: National Pollutant Discharge Elimination System (NPDES) Annual Reporting Work Authorization.
1.BACKGROUND/HISTORY
    
 

Issue Statement: The City is required to comply with Federal and State regulations for the National Pollutant Discharge Elimination System (NPDES) Permit for Municipal Separated Storm Sewer Systems (MS4).

 

Recommended Action: The City Commission adopt a resolution approving the work authorization with Hazen and Sawyer for National Pollutant Discharge Elimination System (NPDES) federal and state permit reporting services for a total amount not-to-exceed $33,950.

 

 

Background: The Environmental Protection Agency (EPA), through the Water Quality Act of 1987, requires Broward County and the City of Oakland Park to comply with the applicable conditions required by the National Pollutant Discharge Elimination System (NPDES) - Municipal Separate Storm Sewer System (MS4) Permit Program.

 

On June 21, 2017, the City Commission authorized the City to participate in an Interlocal Agreement (ILA) with Broward County and 26 other cities in Broward County for reporting and compliance with the NPDES MS4 Program.  In 2017, Broward County and other co-permittees entered into a new five-year permit cycle relative to the NPDES MS4 Permit. Th fifth cycle runs through December 2021 (with reporting due in 2022).  Reporting associated with Years 1, 2, 3, and 4 has been completed.

 

2.CURRENT ACTIVITY
    
 

The NPDES Permit consist of a five-year cycle which began in 2017.  The City already completed the first four years of reporting to the Florida Department of Environmental Protection (DEP).  The City is currently in full compliance. The City is required to submit the fifth year NPDES permit report by June 30, 2022. In order to compile and prepare the required reporting data, staff is proposing to retain Hazen and Sawyer to assist in meeting the annual NPDES reporting requirements of our Stormwater Management Program for Year 5. The combined cost for these services is $33,950, which will provide annual permit reporting assistance until 2022. The scope includes:

 

  • Task 1 – NPDES Permit Year 5 Annual Report Preparation Assistance

 

  • Task 2 – Miscellaneous NPDES Permit Assistance

 

The proposed work authorization is under the City’s continuing services contract for professional services (CCNA) awarded in 2019.

3.FINANCIAL IMPACT
    
 

Funds are available within the FY 2022 Operating Budget of the Stormwater Fund for the National Pollutant Discharge Elimination System (NPDES) Permit reporting services.   As shown on the fee estimate from Hazen and Sawyer attached to the Work Authorization in Exhibit A, the firm's professional services fee is an amount not-to-exceed $33,950.
