Issue Statement:  Section 5-182.5 of the Broward County Land Development Code requires delineated Trafficways within an area proposed to be developed to be conveyed to the public. Portions of the front edge of the Sky Building project include Trafficway areas and are required to be dedicated to the Florida Department of Transportation by easement prior to issuance of construction permits.

Recommended Action:   The City Commission adopt a resolution authorizing appropriate City Officials to enter into a Perpetual Easement Interest Agreement between The City of Oakland Park and the Florida Department of Transportation to dedicate property along the front edge of the property located at 3701 and 3801 North Dixie Highway to the public for right-of-way in order to comply with requirements of the Broward County Trafficways Plan and the Broward County Land Development Code.

Background: The City entered a Development Agreement with Oakland Park Dixie LLC (NR Investments) for construction of a new mixed-use project to include residential units, commercial space, and a new City Hall. This agreement was most recently amended through Resolution R-2021-158 adopted November 11, 2021. The development project is addressing required actions for issuance of construction permits including the required conveyance of Trafficway areas to the public for right-of-way.

To develop the site and implement the Site Development Plan, small areas of land along the North Dixie Highway frontage of the Sky Building project site are required to be dedicated by Perpetual Easement Interest to the Florida Department of Transportation for compliance with the Broward County Trafficways Plan. An agreement needs to be executed for this dedication.

The following three areas are to be dedicated:

·       A triangular area abutting the southwest corner of the intersection of North Dixie Highway and NE 39 Street that contains seven (7) square feet, more or less.

·       A semicircular area abutting the northwest corner of the intersection of North Dixie Highway and NE 38 Street that contains 223 square feet, more or less.

·       An elongated triangle-shaped area abutting the northwest corner of the intersection of North Dixie Highway and NE 38 Street that contains 602 square feet, more or less.

The agreement would create a right-of-way dedication of these three areas for the Florida Department of Transportation. These dedication areas would not affect the design, positioning, or configuration of the proposed buildings of the Sky Building Project.
