Issue Statement: The five decorative fountains on Main Street were constructed in 2013. The City’s decorative fountains along Main Street require renovation. In spring 2021, an invitation to bid was advertised for the fountain renovations but no bids were received. Since the failure to receive any bids, Public Works staff have reached out to over 15 different contractors to request quotes to renovate the fountains. Due to the specialty nature of fountain rehab and repair work, only one contractor provided a quote. In late 2021, the fountain located at NE 37th Street was successfully renovated by MC Pavers.
Given the success of the first fountain renovation, the specialty nature of the work, and the prior non-responsiveness of other companies, Public Works is seeking to contract with MC Pavers for the remaining four fountain renovations in the amount of $61,690. Given the non-responsiveness of vendors to requests for quotations and the lack of submitted bids, staff is recommending that the City Commission waive by supermajority vote competitive procurement in accordance with Section 2-200 of the City Code of Ordinances.
Recommended Action: The City Commission adopt a resolution to 1) waive competitive procurement in accordance with Sec. 2-200 of the Oakland Park Code of Ordinances, 2) award a contract to MC Pavers for an amount not-to-exceed $61,690 to renovate the four remaining downtown fountains, and 3) adopt the proposed budget amendment.
Background: The five decorative fountains on Main Street were constructed in 2013. In early 2021, the City released an invitation to bid for the fountain repair and received no bids in response. Staff then personally reached out to over 15 companies who advised they declined to bid due to either the specialty nature of fountain repair, their workload being too great, or the small size of the project. Staff was able to locate a small business contractor MC Paver who advised he could perform the work.
The City contracted with MC Paver to repair the fountain at 37th Street as a pilot project to determine if the quality of work would meet the City's expectations. The work was successfully completed to the City's satisfaction. Due to the difficulty in locating a qualified contractor, the City seeks to continue the engagement with MC Paver for the remaining four fountains.
