SUBJECT: Partial acceptance of Utility Easements from RRPV Oakland Park Comm LLLP (RAM Realty Associates V LLC) for the property located on the southeast corner of East Oakland Park Blvd. and NE 6th Avenue.
1.BACKGROUND/HISTORY
    
 

Issue Statement: Dedication of utility easements to the City of Oakland Park is required for the maintenance and operation of new water mains, water services, sewer mains, sewer laterals, fire hydrants and other appurtenances installed within the Ram Development site on the southeast corner of East Oakland Park Blvd and NE 6th Avenue.

 

Recommended Action:  Acceptance of the utility easements required by the City of Oakland Park Public Works Department to facilitate the proper maintenance and operation of the underground utilities within the Ram Development site on the southeast corner of East Oakland Park Blvd and NE 6th Avenue.

 

Background: Ram Development is the developer responsible for developing the Blys and Sprouts Grocery store site located on the southeast corner of East Oakland Park Blvd and NE 6th Avenue. Development of the site required the installation of new water and sewer infrastructure to serve the proposed buildings within the development. The developer intends to dedicate this utility to the City so that City personnel may have access to the utilities to properly maintain and operate the facilities. The easement also holds the City harmless from and against all claims, liability and expense arising from the removal of any natural or man-made obstructions, including the expense of removing, relocating, restoring and replacing such obstruction. As-built engineering drawings designed by Bowman Consulting Group, Ltd. for this portion of the easements were approved, required construction permits were issued and final inspections were approved by the City. Additionally, all outside agency certifications and approvals have been obtained.

2.CURRENT ACTIVITY
    
 

The utilities (water mains, mater services, sewer mains, sewer laterals, hydrants and other appurtenances) were installed by the developer. RAM Development has provided easement documents to dedicate the utilities defined in the agreement to the City. Engineering, as well as, Public Works staff reviewed the easement document, sketch/legal description and inspected the infrastructure for integrity and compliance. All infrastructure and appurtenances associated with this easement dedication have been installed according to the City’s Engineering Standards, certified by Broward County Health & Environmental Protection Departments, and the easement is adequate for maintenance.

4.RECOMMENDATION
    
 

That City Commission adopt the Resolution and accept the installed infrastructure, appurtenances, and the utility easements as described in the attached documents from RRPV Oakland Park Comm LLLP (RAM Realty Associates V LLC) for the property located on the southeast corner of East Oakland Park Blvd and NE 6th Avenue.
