Issue Statement: On May 19, 2021, the City Commission approved the Construction Services Agreement and Guaranteed Maximum Price (GMP) for the Construction Manager at Risk (CMAR) Services related to the City Park Phase 1 project. 

During the construction phase, there were several unforeseen conditions that impacted the project which required modifications to the project design. Staff engaged the Architect of Record (AOR), Chen Moore and Associates, Inc., to conduct an analysis and determine the most cost-effective way to address these unforeseen conditions. As a result, the modifications require additional design.

Due to a delay in delivery of certain material/equipment and unforeseen site conditions, the project schedule was delayed and this requires the AOR to be on site longer than originally anticipated. Due to the additional design work and the delay in certain materials/equipment there is a need to approve additional work authorizations for the AOR to cover design costs and the additional time being spent on the project.

Recommended Action: City Commission adopt a resolution approving Work Authorizations with Chen Moore and Associates, Inc. for additional design services and construction administration services for the City Park Phase 1 project in an amount not to exceed $13,000 and $18,500, respectively; and to approve the proposed Budget Amendment. 

The proposed work authorization is under the City’s continuing services contract for professional services (CCNA) currently in effect through September 18, 2023. 

The City Park Phase I project was scheduled to be completed by July 2022. Due to unforeseen conditions and delays in the delivery of materials/equipment, the completion date has been extended.

During the project's construction and renovation of the existing concession stand, it was determined that the concession stand required additional design efforts beyond those included in the construction plans. To address those issues, Chen Moore, the Architect of Record (AOR), must provide additional design services.  

In addition to the additional design services, the AOR is required to perform construction administration services throughout the project to respond to any questions from the contractor, review site work, and address any design and unforeseen issues that may arise. Due to unforeseen conditions and delays in materials/equipment, the project schedule was extended, which necessitates an extension of services with the AOR for construction administration. 

Estimated Completion is scheduled for October 2022. 

As shown in the attached Work Authorizations, the total estimated cost for the architectural and engineering services for additional design and construction administration services for the City Park Phase 1 Project is $13,000 and $18,500, respectively.   Attached in Exhibit A is the proposed Budget Amendment providing additional funds for design and CEI services.   The proposed expenditures are as follows:
