SUBJECT: Code Lien Settlement for 1502 NE 36 Street
1.BACKGROUND/HISTORY
    
 

Issue Statement: The owner of the residential property located at 1502 NE 36 Street, is requesting settlement of outstanding code enforcement lien and fine of $73,200, the details of which are as follows:

 

Case 181678:

All Violations: $100/day
Hearing date: 05/16/2017

Required compliance date: 06/30/2017

Violation of SEC.5.3(A) – Work without a permit - Complied: 03/01/2018

Violation of SEC.24.79.1(E)(5)(E) – Repair or replace fence in back of building – Complied: 03/01/2018

Violation of SEC.24.79.1(E)(5)(B) – Crack in exterior wall, eaves need repair – Complied: 03/01/2018

Total fine / lien - $73,200

 

 

Recommended Action: The City Commission approve the proposed settlement offer of  $21,960 or 30% of $73,200, plus $375 in recording and processing fees, for a total of $22,335 for Code Enforcement Lien Code Case # 181678 with Malcolm C Kolpak Estate, owner of 1502 NE 36 Street, a residential property.

 
2.CURRENT ACTIVITY
    
 The offer is $22,335 ($21,960, plus $375 in recording and processing fees). The total settlement amount is to be paid within sixty (60) days of the City Commission’s approval. Failure to pay within the sixty (60) days will void the settlement.
3.FINANCIAL IMPACT

The proposed settlement will result in the City receiving $18,492 to offset expenses incurred by the City.
4.RECOMMENDATION
    
 It is recommended that the City Commission approve the proposed settlement offer of $22,335 ($21,960, plus $375 in recording and processing fees) for Code Enforcement Lien Code Case # 181678 with Malcolm C Kolpak Estate, owner of 1502 NE 36 ST, a residential property.
